These Terms and Conditions govern purchases made from Kricket Design through this website.
By placing an order, you confirm that you have read, understood, and agreed to these Terms and Conditions.

2. Products
Kricket Design produces independently manufactured, small-batch aftermarket automotive products.
Product descriptions, specifications, photographs, prices, availability, and compatibility information are provided on the applicable product page.
The Volkswagen MK4 wagon rear hatch spoiler is:
- An unfinished aftermarket exterior accessory
- Produced in small batches
- Supplied without final bodywork, primer, paint, or installation
- Intended to require inspection, test-fitting, preparation, finishing, and secure installation
- Not an original Volkswagen component
- Not manufactured, sponsored, endorsed, tested, or authorized by Volkswagen
Volkswagen and applicable vehicle-model names are used only to identify intended compatibility. All trademarks remain the property of their respective owners.
3. Intended use and legal compliance
The spoiler is sold for off-road, show, display, or competition use only.
Kricket Design does not represent or guarantee that the product complies with every motor-vehicle, highway, equipment, inspection, insurance, or road-use requirement that may apply in the purchaser’s jurisdiction.
The purchaser is responsible for determining:
- Whether possession, installation, and use are lawful
- Whether installation could affect vehicle inspection or insurance
- Whether the product is suitable for the purchaser’s vehicle and intended use
- Whether any inspection, approval, modification, or professional advice is required
4. Compatibility and fitment
The purchaser is responsible for confirming compatibility before ordering, altering, finishing, or installing the product.
The current spoiler is designed for the Volkswagen MK4 wagon platform identified on the product page. Compatibility is not guaranteed for:
- Sedans, hatchbacks, or other body styles
- Vehicles with collision damage or previous body repairs
- Modified or replacement rear hatches
- Vehicles affected by corrosion, distortion, dimensional differences, or structural damage
- Applications not expressly identified on the product page
Because products are made in small batches, minor variations in surface texture, edges, dimensions, colour, or appearance may occur. These variations are not necessarily defects where the product remains reasonably consistent with its description and intended application.
5. Unfinished condition
The purchaser acknowledges that the spoiler is sold unfinished.
Depending on the desired result and individual vehicle, it may require:
- Inspection and test-fitting
- Minor trimming or adjustment
- Filling and sanding
- Surface preparation
- Priming and painting
- Selection of suitable mounting materials
- Professional installation
Photographs of painted or installed products are examples of completed installations. Unless expressly stated otherwise, paint, bodywork, installation labour, tools, adhesives, mounting materials, and vehicles are not included.
The purchaser should not expect the delivered unfinished product to have the appearance of a professionally prepared, painted, and installed example.
6. Inspection before alteration
The purchaser or installer must inspect and carefully dry test-fit the product before:
- Sanding
- Drilling
- Cutting or trimming
- Filling
- Priming or painting
- Applying adhesive or mounting tape
- Installing or otherwise modifying the product
The product must not be altered or installed if it:
- Arrived materially damaged
- Appears materially defective
- Does not fit the intended application
- Cannot be securely installed
- Has been distorted during shipping or storage
- Is otherwise unsuitable for the proposed installation
Concerns should be reported to Kricket Design before alteration or installation. The purchaser should provide the order number, a description of the concern, and clear photographs.
Once a product has been altered, finished, attached, or installed, Kricket Design may be unable to verify its original condition or determine whether a concern resulted from manufacturing, preparation, installation, or subsequent use.
7. Installation responsibilities
Professional fitting and installation by a qualified automotive body or repair professional are strongly recommended.
The purchaser and installer are responsible for:
- Inspecting and test-fitting the product
- Confirming vehicle compatibility
- Selecting appropriate mounting materials and methods
- Preparing all mounting surfaces correctly
- Following instructions supplied with the product
- Following the mounting-material manufacturer’s instructions
- Allowing adhesives, coatings, or mounting materials to cure fully
- Confirming adequate clearance around the hatch, glass, paint, trim, antenna, and bodywork
- Confirming that the product is securely attached before operating the vehicle
- Periodically inspecting the product and its attachment
- Discontinuing use if the product becomes loose, cracked, damaged, distorted, or insecure
Installation techniques shown in photographs, social-media posts, or other customers’ examples may not be suitable for every vehicle or situation.
8. Assumption of responsibility and risk
The purchaser acknowledges that preparing, modifying, and installing an exterior automotive accessory involves risk.
Potential risks include:
- Damage to paint, glass, trim, or bodywork
- Improper fitment
- Adhesive or attachment failure
- Water intrusion
- Wind or vibration damage
- Interference with hatch operation
- Detachment while the vehicle is moving
- Damage to the purchaser’s vehicle
- Damage to other vehicles or property
- Personal injury
The purchaser accepts responsibility for fitment, preparation, installation, inspection, maintenance, lawful use, and the selection of suitable mounting materials and methods, except to the extent that responsibility cannot legally be excluded.
9. Prices and currency
All prices are displayed and payable in Canadian dollars unless expressly stated otherwise.
Product prices exclude shipping and applicable GST/HST unless the website expressly indicates that those amounts are included.
The checkout page will display an itemized total before the order is submitted, including:
- Product price
- Shipping charges
- Applicable GST/HST
- Any other disclosed charge
The customer will have an opportunity to review the order, correct information, and accept or decline the purchase before payment.
10. Taxes
Applicable GST/HST is calculated according to the delivery destination and displayed during checkout.
The purchaser is responsible for any tax, duty, brokerage fee, or other government charge that applies but could not reasonably be calculated and collected by Kricket Design during checkout.
11. Payment
Online credit- and debit-card payments are processed through Square.
Kricket Design does not receive or store the customer’s complete payment-card number.
By submitting an order, the customer authorizes payment of the total displayed at checkout.
An order is not considered paid until payment has been successfully authorized and confirmed.
Kricket Design may cancel and refund an order before shipment where:
- The product is unavailable
- A material pricing or product-description error occurred
- Payment cannot be verified
- Fraud or unauthorized activity is reasonably suspected
- Delivery to the supplied address is unavailable
- Fulfilling the order would violate applicable law
12. Inventory and order acceptance
Products are manufactured in small batches and may have limited availability.
Adding a product to the shopping cart does not reserve it. Inventory is normally reserved only after checkout and successful payment.
An automated order confirmation acknowledges receipt of the order but does not require Kricket Design to fulfil an order affected by fraud, payment failure, unavailable inventory, a material website error, or an unlawful delivery request.
If Kricket Design cannot fulfil a paid order, the customer will be contacted and offered an appropriate resolution, including a refund where required.
13. Shipping and delivery
Canadian orders are shipped through Chit Chats and its partner carriers unless a different arrangement is displayed during checkout or agreed to in writing.
Shipping rates depend on factors including:
- Delivery address
- Parcel weight and dimensions
- Selected service
- Carrier availability
- Remote-location limitations
- Seasonal and operational conditions
In-stock orders will normally be prepared and tendered to the carrier within 3-5 business days after payment.
The selected service and estimated shipping cost will be displayed before the order is submitted. Delivery will be made to the shipping address supplied by the customer.
Delivery dates and transit times are estimates and are not guarantees.
The customer is responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect or incomplete address may be charged to the customer where permitted by law.
14. Order cancellations
A customer may request cancellation before an order has shipped. Cancellation requests are considered individually and are not guaranteed.
An order normally cannot be cancelled after:
- It has been packaged or materially prepared for shipment
- Shipping postage has been purchased
- It has been transferred to Chit Chats or another carrier
- Work specifically requested by the customer has begun
Where Kricket Design approves a cancellation before shipment, the amount paid will be refunded, subject to non-refundable third-party expenses where permitted by law.
Nothing in this section limits a cancellation right that cannot legally be excluded.
15. Final-sale policy
Unless Kricket Design expressly agrees otherwise in writing, all products are final sale.
Returns, refunds, and exchanges are not offered for:
- Change of mind or buyer’s remorse
- Accidental ordering
- A purchaser changing or abandoning their project
- A purchaser deciding not to complete the required preparation, finishing, or installation
- Incorrect assumptions about compatibility or fitment
- Expectations inconsistent with the product being clearly described as unfinished
- Shipping costs or delivery estimates disclosed before purchase
- A purchaser finding another product or alternative after ordering
Kricket Design may consider an appropriate remedy on a case-by-case basis where:
- The wrong product was supplied
- The product was materially damaged during shipping
- The product has a material manufacturing defect
- The product is materially different from its description
- A remedy is required by applicable law
Approval of a remedy in one situation does not create an obligation to approve a return, refund, or exchange in another situation.
16. Conditions for an authorized return
A customer must contact Kricket Design and receive written authorization before returning a product. Unauthorized returns may be refused.
Any product approved for return must be:
- Unused
- Uninstalled
- Unmodified
- Undamaged
- In its original condition
- Securely packaged for transportation
A careful dry test-fit is permitted solely to confirm basic compatibility, provided the product is not attached, altered, marked, contaminated, or damaged.
Products used beyond reasonable inspection and dry test-fitting are not eligible for a discretionary return.
Kricket Design may inspect an authorized return before determining whether a repair, replacement, refund, or another remedy is appropriate.
Where a return is not caused by an error by Kricket Design, shipping damage, a material defect, or a legal obligation:
- Return shipping is the purchaser’s responsibility
- Original shipping charges are not refundable
- The purchaser is responsible for loss or damage during return transportation
Nothing in these Terms limits a statutory consumer right or remedy that cannot legally be waived.
17. Shipping damage
The purchaser should inspect the parcel and product promptly after delivery.
Visible shipping damage should be reported within 48 hours where reasonably possible. The purchaser should:
- Retain the carton and all packaging
- Photograph any visible damage before opening the parcel
- Photograph the shipping label
- Photograph the internal packaging
- Photograph the product and the damage
- Avoid altering or installing the product
- Contact Kricket Design with the order number
Kricket Design will review the information and determine the appropriate next step, which may include assistance with a carrier claim, repair, replacement, or refund.
A delay in reporting damage may make a carrier claim more difficult but does not eliminate any right that cannot legally be waived.
18. Product defects and incorrect orders
A product concern should be reported before alteration or installation whenever reasonably possible.
Where a product is materially defective, materially different from its description, damaged during shipping, or incorrectly supplied, Kricket Design will review the circumstances and determine an appropriate remedy.
Depending on the circumstances, a remedy may include:
- Repair
- Replacement
- Partial refund
- Full refund
The remedy will depend on the nature of the issue, the product’s condition, the available evidence, and applicable law.
19. Limitation of liability
To the fullest extent permitted by applicable law, Kricket Design is not responsible for loss, injury, or damage caused by or arising from:
- Improper preparation, finishing, or installation
- Unsuitable adhesives, fasteners, tapes, coatings, tools, or mounting methods
- Installation on an incompatible, damaged, corroded, repaired, distorted, or modified vehicle
- Failure to inspect or dry test-fit the product
- Failure to follow supplied instructions
- Failure to follow a mounting-material manufacturer’s instructions
- Unauthorized alteration or modification
- Inadequate curing or surface preparation
- Failure to inspect or maintain the installation
- Continued use after loosening, cracking, deterioration, or damage becomes apparent
- Collision, impact, road debris, automated car washes, vandalism, theft, or misuse
- Severe weather or environmental exposure
- Use contrary to these Terms or the stated intended use
To the fullest extent permitted by law, Kricket Design will not be liable for indirect, incidental, special, consequential, exemplary, or economic losses, including:
- Loss of vehicle use
- Towing expenses
- Vehicle-rental costs
- Lost income or profits
- Repainting or refinishing costs
- Unrelated repair expenses
Where liability may legally be limited, Kricket Design’s total liability relating to a purchased product will not exceed the amount paid for that product.
Nothing in these Terms excludes or limits:
- Liability that cannot legally be excluded
- Statutory consumer rights or remedies
- An obligation, representation, or warranty that cannot legally be waived
20. Events beyond our control
Kricket Design is not responsible for delays or failure to perform caused by events reasonably beyond its control, including:
- Severe weather
- Natural disasters
- Fire or flood
- Power, communications, or internet failure
- Transportation or carrier interruption
- Labour disruption
- Government action
- Public emergency
- Supply shortages
Kricket Design will make reasonable efforts to notify affected customers and resume performance when reasonably possible.
This section does not remove any cancellation, delivery, or refund obligation imposed by law.
21. Product reviews
Customers may be permitted to submit ratings and product reviews.
Kricket Design may moderate, decline, hide, or remove content containing:
- Spam or unrelated advertising
- Threats, harassment, hate, or abusive content
- Personal or confidential information
- Illegal or infringing content
- Impersonation or fraudulent claims
- Material unrelated to the product or customer experience
Kricket Design will not remove a review solely because it expresses a genuine negative opinion or describes a genuine customer experience.
By submitting a review, the customer gives Kricket Design permission to display the submitted rating, review, and display name on the website and in related business communications.
22. Privacy
Personal information is collected, used, retained, protected, and shared according to the Kricket Design Privacy Policy.
The Privacy Policy forms part of these Terms and Conditions.
23. Electronic communications
By placing an order or contacting Kricket Design, the customer agrees to receive electronic communications necessary to:
- Confirm and administer the order
- Confirm payment
- Provide receipts
- Communicate about preparation and fulfilment
- Provide shipping and tracking updates
- Respond to support requests
- Address returns, disputes, or product concerns
These transactional communications are separate from promotional marketing.
24. Changes to these Terms
Kricket Design may update these Terms when its products, services, legal obligations, or business practices change.
The Terms applicable to an order are the version presented or made available to the customer when that order is placed.
25. Governing law
These Terms are governed by the laws of Nova Scotia and the applicable federal laws of Canada.
Any dispute will be subject to the courts having jurisdiction in Nova Scotia, except where applicable consumer law requires otherwise.
26. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be limited or removed only to the extent necessary.
